Natural Nuisance Claims
Japanese Knotweed Claims
Japanese Knotweed is a non-native invasive plant that was brought to the UK in the 19th Century as an ornamental plant. It can now be found in many gardens and it poses an enormous risk to the bio-diversity in the UK.
Japanese Knotweed can spread very quickly causing damage to your home along the way. If untreated, the presence of Japanese Knotweed on or around your property can not only prevent or delay its sale, but it can also reduce the property’s value.
It’s important that removal of Japanese Knotweed is completed by a specialist who operates within the conditions of treatment of invasive and non-native plants and requires an environmental permit to do so.
Can I claim for Japanese Knotweed damage to my property?
If you are experiencing encroachment of this plant on your land from neighbouring property then you may be able to claim. Similarly, if the plant can be seen from your property within 7 meters, you may be able to claim.
If you believe that Japanese Knotweed was present on your land before you purchased it and it was not disclosed in the conveyancing transaction, you may be able to claim.
What will my Natural Nuisance claim include?
Depending on the nature and extent of any damage caused, your claim may include:
- Cost of removal of the invasive plant;
- Costs of the repairs to your property caused by the invasive plant;
- Cost of an insurance backed treatment package;
- Potential loss of market value of the property;
- Potential loss of investment value/rental income of the property;
- Compensation for the loss of enjoyment and use of your land.
